Legal terms and conditions for using our website and services

Introduction & Acceptance

These Terms of Service ("Terms") constitute a legal agreement between you and Practical Tech Leader LLC ("Company," "we," "us," "our," or "Rebecca Sutter") governing your use of our website (practicaltechleader.com) and services (coaching, therapy, and related offerings).

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our website and services constitutes acceptance of modified Terms.

1. Services Provided

1.1 IT Leadership Coaching

Practical Tech Leader offers coaching services for engineering managers, tech leads, and CTOs. Coaching includes:

  • Discovery call consultations
  • 1-on-1 coaching sessions
  • Group cohort programs
  • Corporate workshops and team training

1.2 Therapy Services

Licensed therapy services are provided in compliance with state licensing requirements and ethical standards. Therapy includes:

  • Individual therapy sessions
  • Intake consultations
  • Ongoing mental health treatment

Important: Therapy services are governed by separate confidentiality agreements and therapeutic privilege.

1.3 No Medical/Mental Health Emergency Services

Our services are NOT emergency services. If you or someone else is in crisis or having thoughts of self-harm:

  • Call 911 or go to the nearest emergency room
  • Call the National Suicide Prevention Lifeline: 988
  • Text "HOME" to Crisis Text Line: 741741
  • Call Trans Lifeline: 877-565-8860

2. User Eligibility

By using our services, you represent and warrant that:

  • You are at least 18 years old (21 in some jurisdictions)
  • You have the legal capacity to enter into this agreement
  • You are not prohibited from receiving our services under applicable law
  • All information provided to us is accurate and truthful
  • You are not using our services for any illegal or unauthorized purpose

3. Fees, Payment & Cancellation

3.1 Coaching Fees

Coaching fees vary based on the program and service level. Specific pricing will be discussed and agreed upon during the discovery call.

3.2 Payment Terms

  • Payment is due at the time services are scheduled unless otherwise agreed
  • We accept credit cards, bank transfers, and other payment methods
  • Payment processing is handled by secure third-party processors
  • You are responsible for any currency conversion fees

3.3 Cancellation & Refund Policy

Coaching:

  • Cancellations with 48+ hours notice: Full refund or reschedule
  • Cancellations with 24-48 hours notice: 50% refund or reschedule
  • Cancellations with less than 24 hours notice: No refund
  • No-shows without notice: Session charged in full

Therapy: Cancellation and refund policies for therapy services will be discussed at intake and may differ from coaching.

3.4 Therapy Insurance & Payment

If therapy services are covered by insurance, you may provide your insurance information. We will work with your insurance company, but you are responsible for any out-of-pocket costs.

4. Scope of Services & Limitations

4.1 Coaching is Not Therapy

Coaching is not a substitute for therapy or mental health treatment. If you are experiencing mental health concerns, we recommend consulting with a licensed mental health professional.

4.2 Coaching is Not Legal/Financial Advice

Our coaching does not constitute legal, financial, investment, or tax advice. Consult appropriate professionals for these matters.

4.3 Results Not Guaranteed

We make no guarantees about specific outcomes. Results depend on your effort, circumstances, and implementation of coaching insights.

4.4 Therapy Limitations

Therapy is a collaborative process. Your participation, honesty, and effort are essential for progress.

5. Confidentiality & Privacy

5.1 Coaching Confidentiality

Information shared during coaching sessions is confidential and will not be disclosed to third parties without your written consent, except as required by law.

5.2 Therapy Confidentiality

Therapy communications are protected by therapist-client privilege and are confidential. Limited exceptions apply (imminent danger to self/others, child/elder abuse, court orders).

5.3 Privacy Policy

Your personal information is protected by our Privacy Policy. Please review it for complete details on data handling practices.

6. Client Responsibilities

As a client, you agree to:

  • Be punctual and prepared for scheduled sessions
  • Provide accurate and honest information
  • Respect appointment times and cancellation policies
  • Respect the professional boundaries of the coaching/therapeutic relationship
  • Disclose any medical conditions or mental health concerns that may affect services
  • Not contact us for emergency situations (see crisis resources above)
  • Not use our services while intoxicated or under the influence of substances

7. Termination of Services

We reserve the right to terminate or refuse services to any client who:

  • Is abusive, disruptive, or threatening
  • Fails to pay agreed-upon fees
  • Misrepresents information or provides false details
  • Uses services for illegal purposes
  • Is not benefiting from services and a referral is appropriate
  • Violates these Terms of Service

We will provide reasonable notice before termination except in cases of immediate concern for safety or ethical violations.

8. Intellectual Property

8.1 Website Content

All content on our website (text, images, logos, designs, code) is the property of Practical Tech Leader LLC or licensed from third parties. You may not reproduce, distribute, or transmit this content without written permission.

8.2 Your Materials

Any materials you submit to us during coaching or therapy remain your property. We may retain them to provide services and maintain records.

8.3 Feedback

If you provide feedback about our services, we may use it to improve our offerings without crediting you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages
  • Our total liability for any claim shall not exceed the amount you paid for services
  • We are not responsible for third-party services (Calendly, payment processors, etc.)
  • We are not liable for website downtime, technical errors, or data loss
  • We assume no liability for your use or reliance on coaching insights or therapy recommendations

Some jurisdictions do not allow limitation of liability, so this may not apply to you.

10. Disclaimers

10.1 "AS-IS" Basis

Our website and services are provided "AS-IS" without warranties of any kind, express or implied.

10.2 No Warranties

We do not warrant that:

  • Services will meet your specific needs or expectations
  • Services will be uninterrupted or error-free
  • Any specific outcomes or results will be achieved
  • Website content is accurate or complete

10.3 No Professional Relationship

Except for licensed therapy services, no professional relationship (doctor-patient, attorney-client, etc.) is established by our coaching services.

11. Indemnification

You agree to indemnify and hold harmless Practical Tech Leader LLC, Rebecca Sutter, and our associates from any claims, damages, or costs arising from:

  • Your use of our website or services
  • Your violation of these Terms
  • Your violation of any law or rights of third parties
  • Your reliance on coaching or therapy recommendations

12. Links & Third-Party Services

Our website may contain links to third-party websites. We are not responsible for their content, practices, or privacy policies. Use third-party services at your own risk.

Third-party services we use (Calendly, Netlify, analytics, payment processors) are governed by their own terms and privacy policies.

13. Dispute Resolution

Before pursuing formal action, we encourage you to contact us to resolve disputes informally.

13.2 Jurisdiction & Governing Law
